The land is situated on the east side of the A59 Preston Skipton trunk road. Access can be gained from the centre of Whalley but the most practical access is off Mitton Road, Whalley turning down Broad Lane next to the railway underpass and turning right onto Ridding Lane which leads up to Whalley sewage works as shown on the plan.

Right of Way

Access Road Maintenance

The maintenance of Ridding Lane is shared equally between the owners of the land to be sold and the sewage treatment works. Maintenance of the half share attributed to the land to be sold will be divided proportionately between the three lots offered for sale.

Boundary Fence Maintenance

Existing fencelines and proposed fence lines will be constructed and / or maintained in accordance with the T marks on the sale plan with the inward T mark being the responsibility of the owner of the land within that boundary. The owner of Lot 2 can fence the south boundary to allow unobstructed access to the sewage treatment works.

Overage Covenant

Lot 1, Lot 3 and the northerly part of Lot 2 which are all part of HM Land Registry Title No. LAN126762 are subject to an overage covenant with a 35% development clawback if planning permission is granted creating an uplift in value payable on implementation of the planning permission for anything other than exclusively agriculture or equestrian use with stabling or the construction of a dwelling house with occupation limited to use in connection with agriculture. The covenant expires in year 2035.
